I have the honour to transmit, in accordance
with Colonial Regulation 187, a petition from the Right
Reverend R. O. Hall, Bishop of Hong Kong, in the matter of
Inland Lot No.76, praying that the Licence of the Crown
may be granted for the sale of a portion of that lot free
from the existing restrictive covenant.
2. It is observed that the existing Crown Lease granted to the Archbishop of Canterbury on 26th of September, 1911, of which a copy is also enclosed, appears to contemplate the possibility of the withdrawal of the restriction of user. "The Bishop of Victoria Hong Kong", a corporation sole, is
now in right of this Crown Lease.
3. In my opinion the circumstances adduced in the petition sufficiently justify the advising of His Majesty in the sense desired.
4. It would appear that reconstruction in the past and the reconstruction now contemplated constitute deviation from the original purposes of the trust, but deviation in the past would not seem to have justified, at any time, the withdrawal of the favourable terms on which the Lot is held, nor would the deviation now contemplated appear to be such as to preclude withdrawal of the restriction.
